Tidelync

Terms & Conditions

Effective November 1, 2026 · Tidelync, operated by Obregon Consulting, Sahuarita, Arizona
Draft for the beta. These terms will be reviewed by an attorney before general release.

1. A planning aid, not a navigation or rescue system

Tidelync is beta software that helps you plan trips and keep someone ashore informed. Forecasts, GO / CAUTION / NO-GO grades, fuel and arrival estimates, routes, marina information, AIS traffic and boater reports can be wrong, late or missing. They do not replace official forecasts and warnings, nautical charts, your own judgment, or the equipment and procedures the law requires on your boat. The captain is always responsible for the decision to go and for the safety of everyone aboard.

Tracking and alerts depend on your phone's GPS, battery and cell coverage, and on services we don't control. They can fail, especially offshore or with the screen locked. Tidelync never contacts the Coast Guard or emergency services; your shore contact does. In an emergency, use VHF channel 16, call 911, or activate your EPIRB or PLB.

2. Your account

You must be 18 or older. Give accurate information, keep your devices secure, and only add a shore contact who knows you're doing so. You're responsible for activity on your account.

3. Reports you post

Fish, wildlife and hazard reports are public. Post only what you saw, at the place you saw it. Don't post anything unlawful, misleading or about private individuals. We may remove reports and suspend accounts that misuse the feature. You give us permission to display, store and use your reports to run and improve Tidelync.

4. Fleet and charter use

Operators who use Tidelync to track boats and captains are responsible for telling their crews, and for having the right to share crew and guest information with us.

5. Beta, changes and price

The beta is free. Features may change, break or be removed. We'll give beta members notice before introducing paid plans, and nothing will be charged without your agreement.

6. No warranty and limited liability

Tidelync is provided "as is" and "as available," without warranties of any kind, including fitness for navigation or safety-of-life use. To the fullest extent the law allows, Obregon Consulting is not liable for indirect, incidental or consequential damages, or for loss, injury or damage arising from reliance on forecasts, grades, routes, alerts or reports. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, which during the free beta is zero. Some jurisdictions don't allow these limits, so they may not fully apply to you.

7. Governing law

These terms are governed by the laws of the State of Arizona, USA. Disputes will be handled in the courts of Pima County, Arizona.

8. SMS Terms (text-message alerts)

Program: Tidelync Safety Alerts. A boater using Tidelync asks you to be their shore contact and sends you a sign-up link. If you choose to, you enter your own mobile number on that page and tick a box agreeing to receive the alerts. You then get one confirmation text. After that you receive texts only when that boater's trip is overdue, they send a check-in, or they ask for help. Alerts include the boat's last position and a live-track link. No marketing messages are sent.

How to opt in: enter your number and tick the consent box on the sign-up page (beta.tidelync.cloud/contact). Consent is not a condition of any purchase. How to opt out: reply STOP at any time; you'll get one confirmation and no further texts. Reply START to resume. Reply HELP for help, or email andres@obregon-consulting.com.

Frequency: message frequency varies with the boater's trips; usually none, a few per trip at most. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

Privacy: mobile numbers and opt-in data are never sold or shared with third parties for marketing. See the privacy policy.
